    kg318... from your initial post you indicated that you "demanded" money back and noted that Company A's practice was "against the law". Now, they are using the same law against you. Not saying it is fair or pretty. Just remember, what you sow, you shall reap.

    It is generally poor practice to go for gung-ho activism in a situation where you are unclear about the law (e.g., non compete) and unable to get good counsel (e.g. immigration and business law attorneys).

    Just keep this in mind. Long term, your peace of mind is worth more than $4K ... just think if there are other ways in which you could have handled this.... in case such event pop up again.

    If I were you, I would have a civil conversation with that company. Tell them that economics took over empathy, that you wish to be in a position where you have less financial loss and would appreciate an amicable parting of ways.
    It's a small world out there. Dont pi*s on anyone, lest it come back to wet your backside!

    Sabre rattling might get you out of this one, but the world still remains a small place!

    I agree with this post. Solve this amicably. Non-compete clause is a strong one and is one-sided.

    If you are worrying about 4k you are worrying on the wrong thing. You need to worry about the non-compete.

    I respectfully disagree. It has nothing to do with marketing, fraud desi companies put up free ads on sulekha, its the mindset of a large number of our audience we are missing and need to account for. maybe it has to do with jugaad.
    Of course many of these expectations cannot be satisfied in a honest non profit.

    A dinner for a family costs $50 easily.
    A movie for a family costs $50.

    The mindset is incepted deep inside and it is extremely difficult to change.

    Sometimes, I see people wanting to do something, but their spouses don't allow them to.

    When I told people that I received GC - some desis who r still waiting got pissed. I heard all sorts of things, some say "You cheated", some say "Never knew you were Eb2", some say, "Are you sure?, have you got the cards yet?, Did you finish biometrics?" Some eb3 folks said "We will get ours too, some issue with finger prints , my husband's boss is very close to the congressman and we have influence in INS", some say "Your lawyer did some magic" etc.....

    People carry such mindsets, it is difficult to bring about awareness and change.

    Ladies and Gentlemen:

    Our nation holds paramount equal treatment under the law. My principal question is, what federal laws may I break so that I am rewarded with amnesty to the tune of $18,000 per year?

    That would bring me parity with the estimated costs to society of illegal aliens. These are in health, education and related social benefits. Oh, and the approximately 30 percent of our prison population which is comprised of some of these aliens. Seems some of the cost is borne by victims who are assaulted by aliens doing the crimes Americans just won�t do.

    I�ll even give you a bargain. As a small business owner, my real and opportunity costs to comply with federal statutes and regulations are substantial. These are not taxes, they are non-deductible costs I incur to comply with federal law. My daughter�s chronic medical condition and my own heart condition also incur substantial expenses. Regarding our health, my family is uninsurable due to these conditions. We have never received assistance under any state or federal programs.

    All of these costs come to something over $27,000 per year. So, when you give me my amnesty and my $18,000 per year, you will fall short of my expenses by approximately $9,000. Since you are wise in the ways of federal accounting, you can inform your constituents that you have in fact saved $9,000 per year, in addition to the moral claim of having granted me amnesty.

    It will be appropriate to consider that in fairness my children should be due anchor amnesty. This from the fact that they still will be my dependents when you soon grant me amnesty. If you delay, well, my daughter will always be my dependent.

    Considering possible delays, especially since fellow citizens will have their own tailored amnesty petitions, I understand if you need to charter a Federal Amnesty Commission. That is sure to renew respect for and compliance with the laws you draft. Any shortfall in compliance, up to say, twelve million offenses, you could graciously accept as appropriate civil disobedience. After all, that would assure you more press time as we enter this latest election cycle.

    You are wise also in federal laws which may be broken with no consequence. I am too busy supporting my family, you, and the twelve million scofflaws and their employers to understand such matters, so I need your guidance. You know where I live, my drivers license number, my social security number, my bank and credit account numbers, as well as my email, internet service provider, taxpayer identification number, mortgage holder, business licenses and telephone numbers.

    Please contact me soon. Given the rising medical and other costs, I need that $18,000 quickly and retroactive to the enactment date of S.1348. It�s only fair.

    I am in a similar position but working on 3 months contract through a consulting company on w2. It is similar to my 485 job details, but it is a short term project.

    Would I get an RFE if I work on contract on W2?

    This is the first time I think, it is worth to contribute.

    99.99% going back to India but still ready to contribute for this cause.

    See if we can do something at international level.

    Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

    I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

    SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

    The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

    Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

    --Hopelessness, negative thinking and depression are real feelings. Many people live in denial. Some realize and never express it till it consumes them completely. Some express it to their relief but may suffer from not knowing the reason causing depressed feelings.

    In your case , you are not in denial, you are expressing it and most importantly, you have identified the reason behind feeling hopeless and depressed.

    If you can do anything to solve the problem, then do it without worrying about the outcome. If the situation is beyond your control, you are not going to solve it by worrying more about it.

    Be in control. Don't let it control you.Keep yourself occupied by doing things that you like and entertain yourself.

    I am going through the same.Yours truly has been waiting for a settled life since 1998.

    FP is definitely not connected to background check. I am sailing in the same boat. My application date was july 17th and notice day was Sep 10th. I opened a SR 45 days back with no response. NSC-TSC transfer case..:confused:

    GKBest, it takes minimum two days to appear on computer records for the customer care to tell you. My application was entered in system on 10th october but rep could only see it on 12th oct.

    I actually spoke to Customer service and I got 2 very different responses.

    1. Wait till you are an old man and then the cards may just come !! (Just Kidding ) she actually said wait for 90 days.

    2. Another CSR told me that the TSC is having technical issues and they are not able to access the Biometric information on approved 485's in their systems. She advised me to download Form I-90 from the USCIS site and fill that in and send it in - if you have a minor on the petition then also send 2 passport size pictures of the minor - this will allow them to access the Biometric screen when they process the I-90. We will get Biometric notices and the Minor will get the card - the Grown ups will get the Cards after the Biometrics are uploaded.

    I have not done this - eventhough I downloaded the I-90 forms - I took a INFOPASS appt and if they suggest that I should do a I-90 then I can get that done right on the spot - I am carrying the filled I-90 with me. Anyhow I-90 is usually submitted to correct errors on the card or to replace a card - however this woman sounded quite knowledgeable - but then there are issues realted to where the I-90 should be sent - this is specially complicated if your case has been transferred a few times like mine was.

    Best is to check with the guys/gals at Infopass -meeting.

    All this was from the rep at the TSC - so not sure if this is applicable to all centers.

    AGAIN THIS IS WHAT I HEARD FROM THE TSC REP - PLEASE USE THIS INFORMATION AT YOUR OWN RISK - I AM NOT SENDING THE I-90 ON MY OWN.

    I will post my Infoapss exp on the 9th of september.

    As you said, please post your experience with Infopass tomorrow. It will be helpful.

    Very strange i mail my I-485 on July 19th and got my receipts and check cashed. But I see other peoples who mailed July 2nd and they are still waiting for receipt? Why is that? Does not make sense.

    This is your first post. Welcome to IV. You may want to spend time on the forum and with state chapters. Getting actively involved may help you.

    During the time of IV rally, I happened to speak with an IV member who is here in this country since early 1990s. He has always maintained his legal status and was unfortunate to restart his greencard process several times due to job changes. He did not have a green card at that time and his PD was not very old.

    Hello All,

    Talked to my lawyer today about the checks; they have been encashed for myself and my spouse on 9/4. My RN starts with SRC.

    My I-140 was approved from Texas and my AOS/485 was mailed on july 2nd and arrived on july 3rd to NSC.

    Just a curious question for those you have already received their RN#. When checking the case status it displays "I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS "...will this message change when EAD has been approved and mailed?

    I received a confirmation from the Ombudsman's office that they have received my case documents and would let me know when it get's assigned to an immigration specialist.

    I have not heard back from them yet... 3 weeks and counting... How long does it take them to followup on the case?
